Owed money after a car accident?

If your car was damaged in an accident that you think was not your fault, you might want to know how you can recover the cost of repairing or replacing your vehicle and other losses, such as hire car costs.

You will need to work out:

    ​Who was at fault?

    When we talk about who is 'at fault', we are trying to work out who caused the car accident. Any driver who fails to take reasonable care when driving their vehicle may have contributed to the accident in some way. You need to think about whether you are at fault, another driver is at fault, or whether you are both partly at fault. For more information, see Fault.

    ​What losses did you suffer as a result of the accident?

    You may have suffered the following losses as a result of the car accident:

    • the cost of repairing the damage to your vehicle, or the cost of replacing your vehicle if it was a 'write-off'
    • the cost of hiring a replacement vehicle while your vehicle was being repaired
    • towing fees
    • the cost of repairing or replacing damaged personal items.

    ​How you can make a claim

    The process for making a claim to recover the cost of repairing or replacing your vehicle and other losses, such as hire car costs, is much the same as the debt recovery process which is explained in the Debt - small claims section of this website.

    If the other driver is insured and was at fault, but you are having problems recovering the money owed to you from their insurance company, you may be able to make a claim to the Financial Ombudsman Service (FOS) if your claim is less than $3,000. This is a free service to resolve disputes about insurance claims. For more information see Dealing with insurance companies.
