Who is responsible? ​

    It is not always clear who is at fault in a car accident. When we talk about 'fault' we are referring to who is legally responsible for the accident. A person may have caused an accident (and be at fault) because they were negligent or did not take reasonable care when driving their car. Sometimes both drivers may be at fault and other times no one will be at fault. One or more drivers may receive a fine or be charged with a traffic offence after an accident, and still not be 'at fault'.

    Owners and drivers

    When you have a car accident, the driver at fault may not always be the person who ends up paying for your damage. For example, where a child is driving their parent's car, the parent may be the person who you claim from.

    Driving for work

    If you are involved in an accident with someone who is driving for work, you may be able to make a claim for the damage to your car from their employer. If you are driving for work and cause an accident, you may still have to pay for the costs of repairs to the car you were driving, and, in some cases, the other car as well.

    Taxis, buses and trucks

    If you are involved in an accident with a taxi, bus or truck, it may be difficult to work out who to claim your damages from. The person driving a taxi, bus or truck might not be the owner and might not be insured.

    Hire cars

    The owner of a hire car is not usually responsible for the damage caused by the driver of that car. This is not always the case when the hire car comes with a driver. You also need to find out what kind of insurance the hire car driver has.

    Bicycles

    Bicycle riders are road users and must generally follow the same road rules as other drivers. However, there are some specific road rules for bicycles. When a bicycle is involved in an accident there can be issues that do not come up in accidents involving only cars.

    Accidents involving animals

    If you have an accident involving an animal, you may be able to make a claim against the owner of the animal. You may also have responsibilities to the animal or the animal's owner.
