​Getting a W​rit for​​ the Levy of Property - Step by step guide 

​Step 1: Get ​th​e forms

You need two forms:

  • Form 65 - Notice of Motion Writ for the Levy of Property.
  • Form 66 - Writ for the Levy of Property

​You can file Form 65 on the NSW​ Online​​ Registry​. You do not have to file Form 66 if you are applying online.

​Step 2: Fill out and​​ si​gn the Notice of Motion

You can fill out this form in neat handwriting in blue or black pen. You can also fill it out on your computer screen. The guide Completing Approved Forms  has instructions on how to do this.

If you need extra space to fill in some of the information, you can attach an extra page to the Notice of Motion. The extra page should have the same heading as the section of the form you are writing about. For example, 'Additional Information to Assist the Sheriff's Office'.

To fill in the Notice of Motion form you will need to have the following information ready:

  • your case number (you will find this on your sealed copy of the Statement of Claim, which is the copy stamped by the court)
  • the name, address and telephone number of the judgment debtor
  • a sealed copy of the judgment
  • the total amount, if any, paid by the judgment debtor since the date of the judgment
  • the amount of interest on the judgment debt since the date of judgment
  • the enforcement costs you have paid since the date of judgment
  • the best times to find the judgment debtor at home (if known)
  • a list of items of value owned by the judgment debtor which the sheriff could seize (if known)
  • a list of anything dangerous at the judgment debtor's home (if known).

Alert Icon When you have finished filling out the form you need to swear or affirm it in front of an approved witness such as a solicitor, barrister or justice of the peace.

Step 3: Fill out a​n​d sign the Writ for the Levy of Property

Step 4: File the forms ​at court

The final step is to take or send the Notice of Motion and the Writ for the Levy of Property to the court where the Statement of Claim was filed.  You should file the original and two copies, one copy for you and one copy for the sheriff. 

You do not need to take or send the forms to the court if you are applying on the NSW Online Registry. 

There is no filing fee but you need to pay the court the sheriff's execution fee of $82.00 (as at 1 July 2016​).

The court will issue the writ without you or the judgment debtor attending court. The court will send the writ to the sheriff's office nearest to the judgment debtor's address. The sheriff will contact you directly regarding the payment of any further fees or if they have any problems executing the writ.  You do not have to provide the judgment debtor with a copy of the writ.
