Responding to enforcement action

If you do not pay the judgment debt, the judgment creditor can take enforcement action to try to get their money. The judgment creditor can enforce the debt up to 12 years from the date of the judgment.

 After the case, if there is a judgment for the plaintiff, the plaintiff is also known as the judgment creditor, and the defendant is also known as the judgment debtor.

The judgment creditor can use more than one type of enforcement at a time. The types of enforcement the judgment creditor can use are: 

    ​Writ for the Delivery of Goods

    The judgment creditor can ask the court to authorise the sheriff to 'seize' (take) the goods and return them to the judgment creditor. The sheriff can also take and sell other property which belongs to you to recover the value of the goods.

     A Writ for the Delivery of Goods can only be used in a recovery of goods claim.

    A Writ for the Delivery of Goods can only be used if the court ordered that the goods be returned to the plaintiff. If the court ordered that you pay the plaintiff for the value of the goods instead (for example, if the goods were lost or destroyed) or damages, the plaintiff may be able to use the options listed below.

    Examination Notice and Examination Order

    The judgment creditor can ask you to provide information about your income, assets, debts and employment. This is done with an Examination Notice or an Examination Order.

    Garnishee Order

    The judgment creditor can ask the court to issue your employer with a Garnishee Order for Wages or Salary. This order forces your employer to take money from your wages and send it to the judgment creditor.

    The judgment creditor can also get a Garnishee Order for Debts. This kind of garnishee order forces your bank or credit union to take money from your account and pay it to the judgment creditor. It can also be used to order anyone else who owes you money, or holds money on your behalf, to pay that money to the judgment creditor.

    Writ for Levy of Property

    The judgment creditor can ask the court to issue a Writ for the Levy of Property. The sheriff can then come to your home and seize and sell some of your belongings, including your car to pay the judgment debt.

    Bankruptcy

    If you owe the judgment creditor more than $5000 they may apply to have you declared bankrupt. If you receive documents called 'Bankruptcy Notice' or 'Creditor's Petition' you should immediately get legal advice.

    You can also become bankrupt voluntarily. Bankruptcy is a big step and you should get legal advice and speak to a financial counsellor before taking this option. You can find a free financial counsellor through the website of the Financial Counsellors' Association of NSW (FCAN).

    Winding Up

    If your company owes money, the judgment creditor may file an application for a winding up order. If you receive a 'Statutory Demand' you should immediately get legal advice.
