Stay of proceedings/stay of enforcement

A stay of enforcement (sometimes called a stay of proceedings) is an order of the court that stops the judgment creditor from enforcing the judgment debt for a period of time.

If you apply to set aside a default judgment, you will usually apply for a stay of enforcement at the same time. If your stay application is granted the stay prevents enforcement action from being taken or from continuing, until the court deals with your application to set aside a default judgment.

If the judgment creditor has applied to the court to issue a Writ for Levy of Property or a Garnishee Order, you may make an urgent application to the court to stop (stay) this enforcement action. You could do this if you need time to make arrangements to borrow money or sell property to pay the debt and avoid the enforcement action. A temporary order staying enforcement action may be made by the court without a hearing and without notifying the judgment creditor. The judgment creditor will then be notified of your application and the temporary stay of order and a date for a short court hearing about the application.

On the date of the hearing the judgment creditor may oppose your application to stay enforcement because:

  • they think you may be transferring or selling assets to avoid paying the debt
  • they think you have avoided paying the debt for a long time.

Alternatively, the judgment creditor could agree to the stay of enforcement.
