What are the goods worth?​

    Why you need to know what the goods are worth

    The value of the goods is important because:

    • if the goods can't be returned because they have been lost or destroyed, the plaintiff can claim an amount of money for their replacement value
    • the plaintiff may want to receive payment for the value of the goods, rather than their return
    • the value of the goods will determine which court the case should be started in
    • if the goods have a very low value, it may not be worth starting a court case.

    How to work out the value of goods

    The value of goods is usually what it would cost to replace them with goods of the same age and condition, but it will depend on the circumstances.

    Evidence about the value of goods could include:

    • The price of second hand goods that are of the same or similar type, quality and condition
    • expert reports  about the value of the goods (for example, from valuers, who will probably charge a fee)
    • any other documents about the value of the goods, like a valuation c​ertificate or  insurance documents
    • any docu​ments that show what was paid for the goods: for example receipts, credit card statements, evidence of electronic payment.

    What was paid for the goods may not be what they are worth now. The value of the goods may have reduced over time.

    You can wor​k out the value of second hand goods by finding more than one advertisement of goods of a similar type and quality and calculating the average price.
