​Going to court – Applicant

This figure is a flow chart with labelled boxes linked by lines.  The flowchart describes what happens when an applicant goes to court for an Apprehended Violence Order (AVO).  

Each box in the flow chart contains a hyperlink to further information. 

The action you take will depend on your responses to each step in the flow chart. The flowchart is described as a list of 9 steps. Where there are possible actions, these are listed beneath that step.

Step 1.  Your case is listed for 'mention' at court [link to Mention]. Possible action:

  • The defendant consents (agrees) to the AVO [link to Mention]. Go to Step 8.

  • The defendant does not consent (agree) to the AVO and the court makes directions for parties to prepare written statements [link to Mention]. Go to Step 5.

  • The defendant gives an undertaking (promise) and you decide to withdraw your application [link to Mention].

  • You and the defendant are ordered to attend mediation [link to Mention]. Go to Step 2.

  • You or the defendant ask to adjourn (postpone) the case [link to Mention]. Go to Step 1.

  • The defendant does not go to court [link to Mention]. Go to Step 3.

  • You do not go to court [link to Mention]. Go to Step 4.

  • You withdraw your application [link to Mention].

Step 2.  You and the defendant are ordered to attend mediation [link to Mention]. Possible action:
