Case study - Rob and Mick
Rob parked his car at a shopping centre. After checking his mirrors, Rob slowly reversed out of a parking spot at the shops when he suddenly felt a bump. Rob had run into a car that was behind him. Rob does not have comprehensive car insurance. Rob tried to resolve the dispute with Mick and sent him a letter of demand to pay for the cost of repairs to his car. Rob has asked his witness to write a witness statement.
Statement of Anna Rossi
I, Anna Rossi, of 3 Arthur Street, Croydon Park NSW 2133, home duties, state:
- On 1 December 20xx at about 3:30pm, I was about to get into my car in the car park next to the shops on Burwood Road, Burwood NSW 2134.
- I noticed that a red Toyota Yaris was driving down the lane behind me.
- I saw a black Mazda 3 reverse out of a car space and collide with the red Toyota Yaris. The red car was moving at the time of the collision.
- My car was parked opposite where the accident happened.
- The driver of the black car got out of his car. He did not seem to be hurt.
- Both drivers exchanged details.
- The driver of the black car said "Did you see the accident?". I said words to the effect "I saw it". He then said "Can you give me your contact details, just in case I need a statement from you". I replied "Yes". I then gave him my contact details.
- It was a sunny day.
- The speed limit in the car park was 20km per hour. The red car seemed to be travelling faster than that.
- I noticed damage to the back left side of the black Mazda 3
- I believe that the contents of this statement are true and correct.
