Case study – Nina and Sandy trading as Beautiful Blooms
Nina works for herself as a personal trainer coaching a small group of regular clients. She is getting married and asks Beautiful Blooms, to provide flowers for her wedding. She pays a deposit of $200 with the outstanding balance to be paid two weeks before the wedding. They agree on the number and type of floral arrangements to be provided, being a bride’s bouquet, 3 x smaller bouquets for the wedding party and 50 table arrangements. Nina is disappointed in the flowers that are delivered on her wedding day and asks for a partial refund of the amount she has paid. Sandy from Beautiful Blooms refuses to give a partial refund.
Nina starts proceedings in the Consumer and Commercial Division of NCAT. A conciliation hearing is unsuccessful and the Tribunal Member directs Nina and Sandy to file (lodge) and serve (give to the other party) statements before the contested hearing.
